Terms of Service

These Terms of Service (“Terms”) govern access to and use of Turnkey Leads, a product operated by Alpha Apps, LLC (“Alpha Apps,” “Company,” “we,” “us,” or “our”). Please read them carefully.

Turnkey Leads helps real estate professionals approve, run, and manage marketing services and related lead workflows. The service may include account authentication, AI-assisted setup and operations, paid-media campaign management, lead capture and routing, SMS and email communications, billing, reporting, support, and compliance records.

Definitions

For these Terms:

  • Account means a Turnkey Leads user account or login credential.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • Approved Media Budget means the customer-approved budget for a specific paid-media campaign, target area, service period, or other approved service scope.
  • Company means Alpha Apps, LLC, 981 Route 228, Mars, PA 16046.
  • Customer means the real estate professional, team, brokerage, business, or other entity that subscribes to or uses Turnkey Leads.
  • Lead means contact information and related context about a person or opportunity that Turnkey Leads captures, receives, qualifies, routes, or provides through the service.
  • Organization means the customer operating unit inside Turnkey Leads that owns service setup, leads, campaign state, team settings, approvals, and reporting.
  • Service means Turnkey Leads, including websites, applications, workflows, AI-assisted features, lead capture, campaign operations, communications, reporting, support, and related services.
  • Service Fee means the Turnkey Leads fee for a service, separate from any approved paid-media budget unless stated otherwise.
  • Target Area means a customer-selected area for campaign setup or service configuration. A Target Area is not an exclusive sales territory unless a separate signed agreement expressly says so.
  • Website means https://www.turnkeyleads.com.
  • You means the person or entity accessing or using the Service. If you use the Service on behalf of a business, brokerage, team, or other entity, you represent that you have authority to bind that entity.

Acceptance and Eligibility

By accessing or using the Service, creating an account, subscribing, approving a service, or receiving Turnkey Leads services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into these Terms. If you use the Service for a real estate business, team, brokerage, or other entity, you are responsible for ensuring that your use complies with applicable licensing, advertising, fair housing, communications, privacy, and consumer-protection laws.

Accounts, Verification, and Security

Turnkey Leads uses passwordless account authentication. Signup and sign-in may require a verified email address and mobile phone number. You agree to provide accurate account information, keep it current, and maintain control of the email address, phone number, and devices used for your account.

You are responsible for activity under your account, including activity by users you invite or authorize. You may not share credentials, bypass authentication, impersonate another person, or use another person’s phone number or email address without permission.

We may require fresh authentication, step-up verification, or additional review for sensitive actions such as billing changes, high-risk account changes, bulk exports, support access, or other security-sensitive workflows.

Turnkey Leads Authentication and Account Security Messages - SMS Terms

These SMS Terms supplement the general Terms and apply only to Turnkey Leads Authentication and Account Security Messages.

Program Name and Operator

The program name is Turnkey Leads Authentication and Account Security Messages. Turnkey Leads is a product operated by Alpha Apps, LLC. When a message begins with “Turnkey Leads:”, Alpha Apps, LLC is operating the program for the Turnkey Leads product.

Program Description

If you provide a mobile number and request SMS verification or sign-in, Turnkey Leads may send you transactional text messages such as one-time passcodes, phone-verification messages, passwordless sign-in codes, account-recovery codes, sensitive-action confirmation codes, and closely related account-security notices.

This Program does not send marketing, promotional, sales, lead-nurturing, customer-care, or conversational AI text messages.

By providing your mobile number and requesting a code or otherwise enabling SMS authentication for your account, you agree that Turnkey Leads may send transactional authentication and account-security text messages to that number. This consent applies only to this authentication and account-security Program. It is not consent for marketing, promotional, sales, lead-nurturing, customer-care, conversational AI, or other unrelated text messages.

Requesting an authentication code, verifying a phone number, creating an account, signing in, verifying an email address, or replying START after an opt-out does not enroll you in any separate SMS marketing or customer-contact program.

Message Frequency

Message frequency varies based on your signup, sign-in, phone-verification, account-recovery, sensitive-action, and account-security activity.

Message and Data Rates

Message and data rates may apply. Alpha Apps, LLC does not charge you for receiving Program messages, but your wireless carrier may charge you under your wireless plan.

Opting Out

Reply STOP to opt out of SMS authentication messages. You may also opt out by replying STOPALL, UNSUBSCRIBE, END, QUIT, CANCEL, REVOKE, or OPTOUT, or by contacting support@turnkeyleads.com. After we receive and process your opt-out, you may receive one confirmation message and then no further Program messages to that number unless you re-enable SMS authentication where permitted.

Because Turnkey Leads uses SMS as the default factor for signing you in and protecting your account, opting out of Program messages may prevent you from receiving the verification codes needed to sign in, complete signup, verify your phone, recover your account, or confirm security-sensitive actions. If your email address is already verified and the relevant flow supports it, you may be able to use an email one-time code as a fallback. Otherwise, you may need to contact support to regain access or change your verification phone number.

Re-Enrollment

If you previously opted out, replying START or UNSTOP may remove a provider-level block and restore this SMS authentication Program where permitted by provider rules, our security policies, and applicable law. Re-enrollment in this Program is not consent for marketing, promotional, sales, lead-nurturing, customer-care, conversational AI, or any other SMS program.

Eligible Numbers and Your Responsibilities

You agree to provide a valid mobile phone number that you own or are otherwise authorized to use. You agree not to provide a phone number associated with another person without that person’s permission. If you stop using a phone number enrolled with Turnkey Leads, you are responsible for updating your account before requesting additional codes so that messages are not sent to a reassigned number.

No Guaranteed Delivery

SMS delivery depends on wireless carriers, mobile devices, operating systems, network conditions, anti-spam filters, and service providers outside Alpha Apps, LLC’s control. We do not guarantee that any Program message will be delivered, delivered promptly, or delivered without error. Carriers and our SMS provider may delay, filter, block, or fail to deliver messages. Where SMS is unavailable or unreliable, Turnkey Leads may offer fallback methods, such as email codes, at our discretion.

Privacy

Information collected and used for the Program is described in our Privacy Policy at https://www.turnkeyleads.com/privacy#sms, including the statement that no mobile information collected or used for Turnkey Leads account authentication, including your mobile phone number, messaging consent, verification status, or opt-in/opt-out data, will be shared, sold, rented, leased, transferred, or otherwise disclosed to third parties, affiliates, business partners, or lead generators for marketing or promotional purposes.

Services, AI Assistance, and Approvals

Turnkey Leads may help customers discover, configure, approve, and operate services such as paid-media campaigns, lead capture, lead qualification, lead nurture, newsletter or list workflows, customer-contact workflows, reporting, and related support.

The Service may use AI-assisted workflows to gather setup information, draft campaign materials, propose actions, summarize leads, classify intent, generate messages, and support operations. AI output may be incomplete, inaccurate, or unsuitable without review. You are responsible for reviewing and approving materials, budgets, outreach, claims, and actions where approval is required or where legal, regulatory, brokerage, brand, or professional judgment is needed.

Turnkey Leads does not provide legal, tax, accounting, lending, brokerage-supervision, or real-estate compliance advice. You remain responsible for professional judgment and legal compliance in your real estate business.

Turnkey Leads may present service proposals that include a Service Fee, Approved Media Budget, expected scope, estimates, creative, message sequences, target areas, or other service parameters. You are responsible for reviewing a proposal before approval.

We will not intentionally incur paid-media spend or dispatch customer-contact outreach on your behalf unless the relevant service has been approved and any required payment or service credit is available. The exact approval and billing workflow may vary by service.

Payments may be processed through third-party payment processors such as Stripe. Your use of payment-processing services may be subject to their terms. You authorize us and our payment processors to charge approved fees, recurring charges, taxes, and other amounts according to the service terms presented at approval.

Unless a service-specific agreement states otherwise, fees are non-refundable once charged, except where required by law or where we approve a credit or refund in writing. If payment fails, we may pause, suspend, or terminate affected services.

You may cancel a recurring service as described in the applicable service flow or by contacting support. Cancellation affects future service periods; it does not automatically refund prior charges or already-incurred vendor spend.

Target Areas, Campaigns, and Lead Routing

Target Areas help configure campaigns and service scope. They are not exclusive territories unless a separate signed agreement expressly grants exclusivity.

Multiple customers may participate in the same geography or market. Lead ownership and routing are decided by Turnkey Leads using trusted origination, attribution evidence, customer-approved campaign records, customer-ingested sources, suppression, consent, fraud, duplicate handling, and other routing controls. Paid-campaign leads generally route to the Organization whose approved campaign caused the relevant paid-media activity or verified paid interaction. Customer-ingested leads generally route to the authenticated or configured customer source. Unattributed, conflicting, invalid, suppressed, or legally restricted submissions may be rejected, quarantined, parked for review, or routed under a documented distribution policy.

Prior paid-campaign capture, attribution evidence, or platform rules may affect whether a later engagement routes back to a prior customer or is handled differently. Turnkey Leads does not guarantee that a customer will receive every lead in a geography, every lead from a landing page, or a fixed quantity or quality of leads.

Lead Data and Customer Use

Lead information is licensed to you for the permitted business purpose supported by the relevant service, consent, and law. You may not sell, rent, transfer, disclose, or use lead information for unrelated purposes unless the applicable consent, law, and written Turnkey Leads agreement permit it.

You are responsible for your use of lead information after it is made available to you, including compliance with:

  1. TCPA, CAN-SPAM, state mini-TCPA, do-not-call, text-message, telemarketing, email, and consumer-protection laws;
  2. fair housing, anti-discrimination, advertising, real-estate licensing, brokerage, MLS, and professional rules;
  3. privacy, data-security, deletion, correction, and consumer-rights obligations;
  4. any consent scope, suppression, opt-out, recipient, purpose, or source restrictions associated with the lead.

You may not use automated systems, AI voice, prerecorded/artificial voice, SMS, calls, email, exports, CRM pushes, or partner disclosures in violation of consent, law, or Turnkey Leads eligibility controls.

Customer Responsibilities and Prohibited Use

You agree not to:

  1. use the Service for unlawful, discriminatory, deceptive, abusive, harassing, or fraudulent purposes;
  2. make false claims in campaigns, listings, landing pages, ads, messages, or customer communications;
  3. bypass approval, billing, consent, suppression, authorization, security, or usage controls;
  4. interfere with the Service, scrape it, reverse engineer it, or access it using unauthorized automation;
  5. upload malware, unlawful data, or data you do not have authority to provide;
  6. share accounts, impersonate others, or misrepresent your authority;
  7. resell, distribute, or transfer leads except as expressly permitted;
  8. contact leads or prospects outside the permitted purpose, scope, channel, jurisdiction, or consent basis;
  9. use the Service in a way that harms deliverability, sender reputation, ad accounts, carrier compliance, or platform trust.

We may suspend or restrict access, pause campaigns, block dispatch, quarantine records, or terminate accounts if we believe use of the Service violates these Terms, law, policy, platform rules, carrier rules, ad-platform rules, or the rights or safety of others.

You authorize Turnkey Leads to send service, account, security, billing, support, and administrative communications to you through the contact methods you provide. Marketing communications, outreach to leads, and customer-contact communications are subject to applicable consent, opt-out, suppression, and eligibility controls.

Consent is scoped. Consent for one channel, seller, sender, recipient, purpose, disclosure, or program does not imply consent for another. A public or partner field such as consent=true, sms_opt_in=true, or can_contact=true is not sufficient by itself unless supported by the required evidence package and policy decision.

You must promptly honor opt-outs, do-not-contact requests, revocations, corrections, deletion instructions, and suppression requirements that apply to your use of leads or customer-contact workflows.

Intellectual Property

The Service, software, workflows, designs, user interface, algorithms, AI prompts and orchestration, documentation, templates, reports, platform-owned campaign frameworks, and other Turnkey Leads materials are owned by Alpha Apps or its licensors and are protected by intellectual property laws.

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal real-estate business purposes.

You retain ownership of information you provide to us, but you grant us the rights needed to host, process, use, disclose, and transmit it to provide the Service, operate approved workflows, improve the Service, secure the Service, comply with law, and enforce these Terms.

If you provide feedback, suggestions, or ideas, we may use them without restriction or compensation.

Aggregated and De-Identified Information

We may create aggregated, statistical, or de-identified information from Service usage, campaign performance, lead outcomes, support activity, and other data. We may use and disclose that information for analytics, benchmarking, product improvement, reporting, research, operations, and business purposes, provided it does not identify you or another individual.

Third-Party Services and Integrations

The Service may rely on or integrate with third-party services such as payment processors, ad platforms, analytics providers, SMS and email providers, AI providers, hosting providers, CRMs, customer websites, and other tools. We are not responsible for third-party services we do not control. Your use of third-party services may be governed by their own terms and policies.

We may pause or modify an integration if required by law, vendor policy, security, deliverability, ad-platform policy, carrier policy, or operational need.

Availability and Changes to the Service

The Service may be unavailable, delayed, limited, changed, or discontinued from time to time. We may modify features, workflows, pricing, service packaging, AI behavior, provider choices, campaign methods, or integrations. We are not liable for delays, outages, filtering, ad-platform disapprovals, carrier blocking, provider failures, or third-party changes outside our reasonable control.

Termination

You may stop using the Service or cancel services as described in the relevant service flow or agreement. We may suspend or terminate access immediately if you breach these Terms, fail to pay amounts due, create legal or security risk, violate platform or carrier rules, misuse lead data, or use the Service in a way that may harm Turnkey Leads, another customer, a consumer, or a third party.

After termination, your right to access the Service ends. Certain provisions survive termination, including payment obligations, lead-use restrictions, compliance obligations, intellectual property, confidentiality where applicable, privacy-related obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and any provision that by its nature should survive.

We may retain account, billing, audit, consent, suppression, attribution, lead, and service records as described in the Privacy Policy and as needed for legal, security, compliance, dispute, and operational purposes.

Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, Alpha Apps disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, performance, and course-of-dealing warranties.

We do not guarantee:

  1. any lead quantity, quality, exclusivity, conversion, revenue, return on ad spend, appointment, listing, sale, or business outcome;
  2. that ads, SMS, email, calls, landing pages, integrations, or AI workflows will be approved, delivered, uninterrupted, timely, error-free, or accepted by third parties;
  3. that attribution, classification, deduplication, AI output, estimates, or recommendations will be perfect;
  4. that the Service will meet every brokerage, MLS, advertising, legal, regulatory, or professional requirement applicable to you.

You are responsible for reviewing outputs, approvals, communications, legal compliance, professional obligations, and business decisions.

Limitation of Liability

To the maximum extent permitted by law, Alpha Apps and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost revenue, lost data, lost goodwill, business interruption, substitute services, lead value, failed delivery, ad-platform action, carrier filtering, or lost business opportunity.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the amount you paid to Alpha Apps for the Service giving rise to the claim during the twelve months before the event giving rise to liability.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you. In those jurisdictions, liability is limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Alpha Apps, its affiliates, licensors, service providers, and their officers, directors, employees, contractors, agents, successors, and assigns from and against claims, damages, losses, liabilities, judgments, penalties, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  1. your use of the Service;
  2. your breach of these Terms;
  3. your use, contact, export, disclosure, or handling of leads or personal information;
  4. your campaigns, ads, claims, approvals, messages, or customer communications;
  5. your violation of law, regulation, carrier rule, platform rule, real-estate rule, privacy obligation, or third-party right;
  6. data, instructions, approvals, or materials you provide.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, excluding conflict-of-law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

Dispute Resolution

Before filing a formal claim, each party agrees to try to resolve the dispute informally by contacting the other party. You can contact us at support@turnkeyleads.com.

If the parties cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms or the Service will be determined by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive or equitable relief in court to protect intellectual property, confidential information, security, or unauthorized use.

The arbitration will be conducted in Butler County, Pennsylvania, unless the parties agree otherwise. The arbitration will be conducted by a single arbitrator.

You and Alpha Apps agree that any dispute will proceed only on an individual basis. Neither party may participate in a class action, class-wide arbitration, private attorney general action, or other representative proceeding, or consolidate a dispute with another person’s dispute, except where this waiver is prohibited by law.

Either party may bring an eligible claim in small claims court.

You represent and warrant that you are not located in a country subject to a United States government embargo or designated by the United States government as a terrorist-supporting country, and that you are not listed on any United States government restricted-party list.

Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, it will be interpreted to accomplish its objectives to the greatest extent permitted by law, and the remaining provisions will remain in effect.

Failure to enforce a provision is not a waiver of the right to enforce it later.

Changes to These Terms

We may modify these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Material changes may be announced through the Service or by another reasonable method. Continued use of the Service after changes become effective means you accept the updated Terms.
